In order to be convicted of drunk driving in Massachusetts, there are three elements that the Commonwealthmust prove beyond a reasonable doubt. These include:
- Operation of a Motor Vehicle;
- On a Public Way;
- While Under the Influence of Intoxicating Liquor, or with a Blood Alcohol Content of .08 or above at the Time of Operation.
