In order to introduce a breathalyzer test in a per se DUI case in Massachusetts, the Commonwealth must meet certain requirements.  For example:

  • The arrestee’s consent shall be documented by the arresting officer or the breath testing officer;
  • The test shall be administered by a certified breath test operator on a certified breath test device; &
  • There shall be two tests that are within a certain range of one another.
