If you are arrested on suspicion of OUI in Massachusetts, and you elect to take a breathalyzer test, the Commonwealth may proceed on two theories to prove guilt. For instance, the government must show:
- Operation of a Motor Vehicle;
- On a Way; and
- While the Operator is either Under the Influence of Alcohol, or with a Breathalyzer Test Reading of .08 or above at the Time of Operation.
