Refusal to submit to a breathalyzer test after an OUI arrest will result in immediate driver’s license suspension. The length of the driver’s license suspension for chemical test refusal will depend on the number of prior convictions and admissions. For instance, if you are at least 21 years old and you refuse the breathalyzer test, your license will be suspended for:
- 180 days on a First Offense;
- 3 Years if you have been previously Convicted of or Admitted to Sufficient Facts for OUI;
- 5 Years if you have two previous Convictions for OUI; &
- LIfe,if you have three prior convictions for OUI.
